After a 5-week trial in Los Angeles, a jury returned a unanimous verdict in favor of Johnson & Johnson on all liability questions (negligence, manufacturing defect, design defect, failure to warn). Plaintiff John Doomey alleged that he is suffering from a fatal cancer, peritoneal mesothelioma, due to asbestos in Johnson & Johnson’s Baby Powder.
He claimed to be a lifelong and substantial user of the product. Plaintiff had two bottles of Johnson & Johnson baby powder in his possession, one of which tested "positive" for asbestos according to Plaintiffs' expert. The team was able to convince the jury that not only was the Plaintiff exaggerating his product use, but that Plaintiff's experts were simply not credible when claiming that there was asbestos in Johnson’s Baby Powder. The jury returned its verdict on all counts in approximately one hour.
