King & Spalding has represented clients in State Attorneys General (“AG”) investigations and litigation in all 50 states and the District of Columbia for more than three decades, including multistate and parallel federal investigations and enforcement actions. We help companies and organizations across industries avoid or minimize the impact of State AG investigations and litigation whenever possible, often engaging simultaneously on the policy and investigative fronts to advance and protect client interests. As deeply experienced trial counsel, we are also prepared to vigorously contest investigations, negotiate favorable resolutions and try cases when necessary. As a firm with deep connections on both sides of the political aisle, we are positioned to engage, as necessary and appropriate, with State AGs at a political level. Our State AG team also counsels clients on potential reputational damage, business disruption, and policy solutions at the state and federal level and defends clients in complex litigation—including lawsuits involving allegations of violations of consumer protection laws.
We have decades of experience handling the full life cycle of these matters: from the first informal inquiry, subpoena or Civil Investigative Demand (CID) through an internal investigation, qui tam actions, obtaining a declination or decision not to proceed, complex litigation, trial or settlement, as well as guidance on proactive and remedial compliance measures every step of the way. We also serve as national or coordinating counsel in multistate, multi-party and independent parallel investigations. We are veterans of the crisis management and public messaging aspects of these matters, skilled in handling both affirmative messaging and discovery negotiations and battles that frequently accompany these investigations.
